Lifelong co-ownership of a business is very much the exception rather than the rule. Owners of businesses tend to part ways for any number of reasons including personal conflicts, irreconcilable differences in business objectives or management style, death, divorce or divergence in personal goals and circumstances. When one or more owners of a business needs to part ways with other owners, the parties on both sides require knowledgeable advice regarding their rights and exposures and the implications of proposed arrangements for separation. Even when no owner intends to depart, many times an owner or owner group will need advice regarding its rights and responsibilities when there is tension among owners. A regular part of Ward Council’s practice consists of providing representation to owners and owner groups in connection with the departure of one or more owners and disputes between owners.
